General Terms and Conditions

These General Terms and Conditions ("Terms") govern the purchase of products from the online store operated by Evalue Praxis Oy at frozencapeshop.com (the "Website" or "Store"). By placing an order or creating an account, you agree to be bound by these Terms.

Buyer: The natural person or entity placing the order ("you").
2. Products and Pricing
All products are described on the Website with prices in Euros (€), including VAT (24% in Finland/EU). Prices exclude delivery costs, which are shown separately before checkout. We reserve the right to correct obvious pricing errors. Product availability is indicated on the Website; we are not liable if a product is out of stock after order confirmation.
3. Placing an Order and Contract Formation
Orders are placed via the Website checkout. The order is a binding offer from you. We confirm acceptance by sending an order confirmation email. The sales contract is formed upon receipt of this confirmation. You must be at least 18 years old or have legal guardian consent to place orders.
4. Payment
Payments are processed securely via Stripe. Accepted methods: credit/debit cards and other Stripe-supported options displayed at checkout. Full payment is required before dispatch. We do not store full payment card details. By paying, you authorize Stripe to process the transaction.
5. Delivery and Shipping
We ship via UPS or Posti (Finland's postal service). Delivery times and costs are displayed before checkout and vary by destination. Risk of loss/damage passes to you upon handover to the carrier. We aim to dispatch within [e.g. 1–3 business days], but times are estimates. For international orders outside EU/EEA, you are responsible for customs duties, taxes, and import fees.
6. Right of Withdrawal (Cancellation Right)
As a consumer in the EU/EEA, you have a 14-day right of withdrawal without giving reasons, starting from the day you (or a third party you designate, not the carrier) receive the goods (or the last item in a multi-part delivery).
To exercise this right, inform us unambiguously (e.g. by email or the model form below) before the period expires. You must return the goods within 14 days of notifying us, at your expense (unless we offer free returns). We refund all payments received (including standard delivery costs) within 14 days of receiving the returned goods or proof of return shipment.
Exceptions to the Right of Withdrawal (Consumer Protection Act and EU rules): The right does not apply to:
- Goods sealed for health/hygiene reasons (e.g. swimwear/underwear) once the seal is broken.
- Customized/personalized goods.
- Goods that deteriorate quickly or become inseparably mixed with others after delivery.

7. Returns and Refunds (Beyond Withdrawal)
For defective/non-conforming goods (warranty/consumer rights): Contact us within a reasonable time (Finnish law provides up to 2–5 years depending on product durability). We cover reasonable return costs for justified claims.
8. Intellectual Property
All content on the Website (photos, descriptions, logos) is our property or licensed to us. You may not copy, reproduce, or use it commercially without permission.
9. Limitation of Liability
We are liable only for direct damages caused by our negligence or willful misconduct, up to the order value. We are not liable for indirect/consequential damages, loss of profit, data, or business interruption. This does not limit liability for death/personal injury or mandatory consumer rights.
10. Force Majeure
We are not liable for delays/non-performance due to events beyond our reasonable control (e.g. strikes, natural disasters, pandemics, supply chain disruptions).
11. Governing Law and Dispute Resolution
These Terms and any contract are governed by Finnish law (excluding conflict of laws rules). Disputes are resolved in Helsinki District Court. As a consumer, you may also use the EU Online Dispute Resolution platform or contact the Finnish Consumer Disputes Board (www.kkv.fi).
12. Changes to Terms
We may update these Terms. Changes are posted on the Website with the "Last updated" date. Continued use after changes constitutes acceptance.
